Terms of Service — P3Space

These terms describe the sale and provision of P3Space, portfolio, programme and project management software delivered as a service. The Polish version is the binding one; this translation is provided for information.

Informational translation · 2026.10.12.1 · in force since 2026-10-12

01Provider

The service is provided by Jacek Bobowik „JCBSOFT", ul. Jabłoniowa 9, 39-400 Tarnobrzeg, VAT ID 8671007677, REGON 831359054 — hereinafter “JCBSOFT”.

Contact: biuro@jcbsoft.pl, +48 506 191 004.

02Business customers only

The service is addressed EXCLUSIVELY to businesses and is not intended for consumers. A purchase requires invoicing details, including a tax identification number.

This does not exclude rights that apply by law to a sole trader whose purchase is not of a professional character for them.

03The service

P3Space runs in a web browser. Each organisation receives its own separate workspace (a “Space”) with its own data, configuration and users.

The scope of features depends on the chosen plan. Current plans and prices are published on the pricing page and form part of the offer.

04Contract and trial

There are TWO separate contracts and each one is concluded at a different moment.

The contract for the free trial is concluded when the workspace is created — after these terms and the privacy policy have been accepted and the e-mail address has been confirmed with the code sent to it. Nothing exists before that: without entering the code no workspace is created.

The contract for the paid subscription is concluded when payment for the chosen plan is confirmed. It is not a continuation or an extension of the trial contract.

A free 14-day trial is available beforehand. Starting it requires confirming the e-mail address with a code sent to it. The trial requires no payment details and does not roll over into a paid subscription.

05Prices and payment currency

All prices are stated in EURO (EUR) and payments are made in that currency.

The price depends on the plan, the billing period (annual or monthly) and the number of users above the number included in the plan. The price shown for annual billing is the monthly equivalent of the annual fee; the fee is charged once for the whole year.

All prices are NET amounts. VAT is added at the rate applicable on the invoice date.

Buyers from another EU member state holding a valid EU VAT number account for the tax under the reverse charge mechanism. For buyers outside the EU the service falls outside the scope of Polish VAT.

06Payment

Payments are handled by Paynow (mElements S.A. / mBank S.A.). Available payment methods are shown on the provider’s payment page.

We do not store card details or any payment authentication data.

07Activation of the purchased service

The purchased plan is activated AUTOMATICALLY and without delay once the payment provider confirms the payment. No further action by the buyer is required.

When buying during a trial, the paid period starts on the day of payment. When renewing, the paid period is added to the end of the current one, so paying early does not shorten the period already paid for.

The service involves no delivery of goods or physical media.

08Invoice

We will send the invoice to the e-mail address given at purchase within 14 working days of the payment clearing, and no later than the 15th day of the month following the month of payment.

The buyer provides their invoicing details when placing the order.

Payment, invoicing and settlement matters are handled at pay@p3space.com.

09Renewal and end of the period

The subscription does NOT renew automatically and no recurring payment is taken. Before the period ends we send reminders to the workspace owner with a link to renew.

After the period ends the workspace becomes read-only for 14 days: you can sign in, review and export your data, but not save changes.

After the read-only period the workspace stops being available, but the data is NOT deleted immediately. We keep it for 6 months so the subscription can be resumed or the data exported on request. After that the workspace and its data are deleted from live systems.

Backups of the DATABASE are taken daily and kept for no longer than 7 days, after which they expire. During that time data deleted from live systems may still exist in a backup — a backup cannot be edited, so the data leaves it only when the backup expires.

FILE CONTENT is not covered by those backups. Attachments and documents are held in object storage, and the daily database backup covers only the records about them, not their contents. This cuts both ways and we state both: a lost file cannot be restored from the database backup, but its deletion is immediate and irreversible — no backup holds it.

After an earlier backup is restored, we re-apply the deletion instructions issued after it was taken. This is a fixed step of the restore procedure, not something done on request.

Deletion before that deadline takes place at the buyer’s request, sent from the workspace owner’s address.

10Termination and refunds

The contract is concluded for a fixed term — the billing period — and expires at its end. The subscription does not renew automatically, so discontinuing it requires no notice: it is enough not to pay for the next period.

We do not refund the fee for an unused part of a period already paid for.

If the service is not activated for reasons on our side, we refund the whole amount within 14 days.

11Complaints

Complaints are accepted at biuro@jcbsoft.pl and in writing at the registered address.

A complaint should state the workspace code, a description of the problem, the date it occurred and the expected resolution.

We handle complaints within 14 days of receipt and reply to the address the complaint came from.

Service requests about how the application works can also be raised from inside it, from any screen.

12Availability and support

Declared availability is 99% per calendar month, measured outside planned maintenance windows.

Downtime excludes: planned maintenance announced at least 48 hours in advance, failures at infrastructure and connectivity providers, force majeure, and the consequences of actions by the buyer or their users.

If availability in a given month falls below the declared level, on request we extend the subscription period by the excess downtime.

Support is provided on business days, 9:00–17:00 CET.

13Liability

In relations with business customers to whom consumer protection rules do not apply, the total liability of JCBSOFT for non-performance or improper performance of the contract is limited, in each successive twelve-month period of its term, to the net fees due for the service in that period.

The cap covers ALL claims arising in that period together — a further claim does not open a new cap.

For the free trial the cap is PLN 1,000.

JCBSOFT is not liable for lost profits.

These limitations do not apply to damage caused intentionally, nor to liability whose limitation is not legally permitted. They do not limit the statutory rights of data subjects or the powers of public authorities.

14Calculations and AI results

Calculations, forecasts, reports and AI answers support decision-making. They depend on the input data, the assumptions made and the configuration. The customer verifies their correctness and suitability before using them for financial, HR, legal or other decisions capable of causing material consequences.

JCBSOFT does not guarantee any particular business outcome from using the service. This does not exclude JCBSOFT’s liability for the service conforming to the contract.

15Customer obligations

The customer ensures a legal basis for processing the data they enter, fulfils their own information obligations and grants users permissions appropriate to their tasks.

The customer is responsible for choosing the recipients of materials shared through the stakeholder portal and for instructions to send data to AI features.

These obligations do not displace JCBSOFT’s own obligations as a processor.

16Changes to these terms

We announce changes by e-mail to the workspace owner at least 14 days before they take effect.

A change does not affect a period already paid for — the terms from the purchase date apply.

Not accepting a change means not renewing for the next period; continued use after the change takes effect constitutes acceptance.
